The following agreement details the terms of use effective when using this apartment and home rental classified ad site.

Mission of ByeByeLogement.com

ByeByeLogement.com is a site specialized in apartment and home rental, intended for lessors and tenants of housing units, which allows to post and search for available housing units in an apartment listing. It is the responsibility of the lessor and tenant to complete the transaction together, when applicable. Even though we are committed in providing the best efforts to insure the apartment and home rental site's security and maintain its integrity, we cannot guaranty and are not responsible of the validity and accuracy of the descriptions of the apartments for rent, nor of the ability of the lessors to display an ad or of the future tenants to lease the said apartment for rent.

Disclaimer of Warranties

BYEBYELOGEMENT.COM'S SERVICES ARE PROVIDED ON AN "AS IS" BASIS, WITHOUT ANY WARRANTIES OR CONDITIONS, WHETHER EXPRESS OR IMPLIED. THE USER UNDERSTANDS THAT BYEBYELOGEMENTS.COM DOES NOT VALIDATE THE MEMBERS' (LESSORS AND TENANTS OF APARTMENTS FOR RENT OR HOME RENTAL) CREDITWORTHINESS, LEGAL STANDING OR CAPACITY TO FOLLOW UP WITH RESPECT TO THEIR COMMITMENTS IN THE APARTMENT LISTING. WE SPECIFICALLY MAKE NO WARRANTIES REGARDING THE RESPONSABILITIES, INCLUDING TITLE TO PROPERTY OF THE APARTMENTS FOR RENT OR HOME RENTAL, MARKET VALUE, RELEVANCE OF THE AD FOR A PARTICULAR USE, AS WELL AS ABSENCE IN CONTRAVENTION OF THIRD-PARY RIGHTS. FURTHERMORE, THE USER ACKNOWLEDGES THAT BYEBYELOGEMENT.COM DOES NOT GARANTY CONTINUED, UNINTERRUPTED AS WELL AS SECURE ACCESS TO ITS SERVICES, AND NUMEROUS FACTORS, BEYOND ITS CONTROL CAN AFFECT THE SITE'S CONNECTION.

Limitation of Liability

IN NO EVENT BYEBYELOGEMENT.COM, ITS AFFILIATED COMPANIES, ADMINISTRATORS, EMPLOYEES AND REPRESENTATIVES CAN BE HELD RESPONSIBLE OF CLAIMS OR DOMMAGES, DIRECT OR INDIRECT, ARISING FROM THE USE OF THIS APARTMENT OR HOME RENTAL SITE, THE SERVICES OFFERED ON THE APARTMENT LISTING OF THIS SITE, THE INFORMATION ON THIS SITE OR THE INTERPRETATION OF THIS AGREEMENT.

Indemnity

YOU AGREE TO INDEMNIFY BYEBYELOGEMENT.COM, ITS AFFILIATED COMPANIES, ADMINISTRATORS, EMPLOYEES AND REPRESENTATIVES FOR ANY AND ALL LIABILITIES (REAL AND INDIRECT), OF KNOWN AND UNKNOWN NATURE, ARISING FROM ANY POSSIBLE SITUATION SUCH AS TRANSACTIONS CARRIED OUT BETWEEN LESSORS AND TENANTS ON THE PRESENT APARTMENT OR HOME RENTAL SITE OR OF THE USE OF THIS SITE.

Trademarks

Trademarks, logos or other intellectual properties, displayed on this apartment and home rental site (collectively called "marks"), whether they are registered or not, are property of ByeByeLogement.com or of a third party, and cannot be used in the apartment listing without the written authorisation of ByeByeLogement.com or its respective owners.

Arbitration

Any issue concerning the agreement of the apartment and home rental site that cannot be settled between the different parties or their representatives will be submitted to arbitration, in accordance with the disposition of the Code of Civil Procedure of Quebec (Canada).

Access to your Data

You can access your personal member data at all times by using your personal page on the apartment and home rental site. Furthermore, you can access your active apartment for rent and home rental ads by using ByeByeLogement.com; however, it is important to note that we do not keep archived ads displayed in the apartment listing. Therefore, we strongly recommend you to save a copy of your apartment for rent or home rental ads in your personal archives.

Also, note that when an apartment for rent or home rental ad is closed, deleted or has reaches its expiration date, the ByeByeLogement.com credit finishes and is not renewed automatically; therefore, it is not possible to reactivate such an ad.

It is possible to modify the different fields of your apartment for rent o home rental ad several times, with the exception of the title and description, for which only one modification is allowed. Therefore, when modifying the title and/or the description of an apartment for rent or home rental ad, it is important to modify both at the same time. Afterwards, NO ADDITIONAL MODIFICATION of the title and description can be performed.

Note that the customer service cannot modify or reactivate an apartment for rent or home rental ad.

Acceptance

This agreement can be modified occasionally. Our services concerning apartment and home rental are only offered to individuals whom have lawful authority to perform transactions. For example, our services are not intended for minors or for users whose privileges have been revoked following fraudulent or wrongful use of the apartment and home rental site.

You have the responsibility of preserving the confidentiality of the password entered during the registration on this apartment and home rental site. You are solely responsible for all acts or omissions that occur under your account and password. Further, you agree to notify us immediately of any unauthorized use of your account or password.

Fees

Posting and Reimbursement Policy

In order to become a member or post an apartment for rent or home rental ad on the ByeByeLogement.com site, a three-step procedure must be executed: define whether you want to post or search for an ad, complete the form and validate it. Afterwards, confirm the information entered in the apartment listing, the selections made, as well as the related fees.

During the confirmation process, the system automatically activates your account as well as the apartment for rent or home rental ads entered.

It is important to note that following this step, which displays your ads in the apartment listing, reimbursement is not an option.

Furthermore, failure to observe the rules can result in:

• The deletion of an apartment for rent or home rental ad (without credit)
• The suspension of an account or package (without credit)

ByeByeLogement.com is a classified ads site, which allows lessors and tenants to post or search apartment and home rental from an apartment listing in a secured, pleasant, fair and equitable environment.

This agreement helps establish guidelines intended to create and maintain a pleasant and meaningful experience.

If you are posting apartment for rent or home rental ads on ByeByeLogement.com, it is strongly recommended to regularly visit the rules related to the use of this apartment and home rental site, as they are updated according to the requirements of the market, community and security.

Failure to observe this agreement can result in:

• The deletion of an apartment for rent or home rental ad (without credit)
• The suspension of an account or package (without credit)
• The suspension of the member

Lessors and housing unit owners cannot post their apartment for rent or home rental ads in a way that defies the guidelines of the ByeByeLogement.com apartment and home rental site; doing so would undermine the credibility of the site.

Especially, it is forbidden to:

• Post an apartment for rent or home rental ad that does not display a home or apartment for rent.
• Post an apartment for rent or home rental ad in which only a Web site is promoted.
• Post abusive content.

ByeByeLogement.com allows lessors and housing unit owners to post their email address in the apartment listing of the apartment and home rental site, in order to allow future tenants to communicate with them. They can also add a link that points to a page describing the apartment for rent in the ad.

Logos/Publicity

Logos are not tolerated on the apartment and home rental site as a way to represent your apartment for rent or home rental ad. In order to publicize your logo, communicate with the Publicity Department at http://www.byebyelogement.com/contact.asp in order to have more information concerning the terms and conditions.

Dispositions intended for the lessors

ByeByeLogement.com allows lessors as well as housing unit owners to lease homes and apartments for rent.

You are solely responsible of the information displayed on this apartment and home rental site, information that cannot be erroneous, inexact, misleading, immoral or illegal. Furthermore, you are responsible of updating the personal information entered at registration, when necessary.

You acknowledge that the information disclosed using voice recognition is not confidential or exclusive, and is not prejudicial to the rights of an individual or entity.

As mentioned previously, even though we are committed in providing the best efforts to insure the apartment and home rental site's security and maintain its integrity, we cannot guaranty and are not responsible of the validity and accuracy of the descriptions displayed in the apartment for rent or home rental ads. Therefore, while using the apartment and home rental site, it is possible to be faced with offensive, prejudicial or erroneous content.

It is important to note that the possibility of engaging in a transaction, after consulting the apartment listing, with foreign nationals, minors or individuals using false identity is present.

The following lists the type of content which you commit not to post on this apartment and home rental site:

Good Conduct

• If we are unable to validate or authenticate the information provided at registration or if we determine the actions you have committed can possibly discredit your legal liability, ours or the one of our users, or if, in our opinion, your behaviour undermines this apartment and home rental site.
